These Terms of Service ("Terms" or "Agreement") constitute a legally binding agreement between you ("you," "user," or "customer") and Attic Evolution ("Company," "we," "us," or "our"), governing your access to and use of our website, communications, and insulation services. By accessing our website, submitting a quote request, or engaging our services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please discontinue use of our website and services immediately.
Section 01
Eligibility
By using our website or services, you represent and warrant that you are at least 18 years of age and that all information you provide to us is accurate, current, and complete. If you are engaging our services on behalf of a business, organization, or property owner, you represent that you have the legal authority to enter into this Agreement on their behalf and to bind them to these Terms.
Section 02
Scope of Services
Attic Evolution provides residential and commercial insulation services in the Dallas-Fort Worth Metroplex, Texas, including but not limited to blown-in insulation, insulation removal, spray foam insulation, and radiant barrier installation.
The specific scope of work for any project will be outlined in a separate written service agreement or proposal provided prior to work beginning. These Terms govern your use of our website and initial inquiry process but do not supersede or replace any separately signed service agreements or contracts. In the event of a conflict between these Terms and a signed service agreement, the signed service agreement shall control.
We reserve the right to decline any service request at our sole discretion.
Section 03
Quotes, Estimates & Payment
All quotes and estimates provided — whether verbally, in writing, or through our website — are based on the scope of work and property conditions assessed at the time of inspection. We reserve the right to revise any quote or estimate if project requirements, site conditions, or the scope of work changes from what was originally assessed.
Payment terms will be specified in your service agreement or invoice. Unless otherwise stated in writing:
- Payment is due upon completion of the project unless a deposit or payment schedule has been agreed upon in writing
- We accept payment by check, cash, or electronic transfer as outlined in your invoice
- Overdue balances may be subject to a late fee as specified in your service agreement
- We reserve the right to suspend or terminate services if payment is not received in a timely manner
- Any additional work requested beyond the agreed scope will be quoted separately and requires written authorization before proceeding
Section 04
Scheduling & Property Access
By booking our services, you agree to provide our team with safe, reasonable access to the property and the attic space on the scheduled date. You are responsible for ensuring that the access area is clear of obstructions and that any pets are secured away from the work area.
We understand schedules change. If you need to reschedule, please notify us at least 48 hours in advance. Cancellations made with less than 24 hours notice may result in a cancellation fee as specified in your service agreement.
Attic Evolution is not responsible for delays caused by conditions beyond our control, including but not limited to extreme weather, inaccessible attic spaces, undisclosed pre-existing conditions, or necessary safety stops identified during the project.
Section 05
Workmanship Warranty
All work completed by Attic Evolution is backed by our Done Right Guarantee. If a service was not completed in the manner described in your service agreement, we will return to correct the issue at no additional charge within a reasonable timeframe after notification.
This workmanship warranty does not cover:
- Damage caused by events beyond our control, including pest infestation, flooding, roof leaks, or structural issues discovered after installation
- Degradation of materials due to abnormal conditions not present or disclosed at the time of installation
- Issues resulting from work performed by other contractors after our installation
- Normal settling of blown-in insulation, which is accounted for in our installation levels
Product warranties are provided by the respective manufacturers and are separate from our workmanship warranty. We will provide manufacturer warranty documentation upon request.
Section 06
Intellectual Property
All content on our website — including but not limited to text, images, logos, graphics, page layouts, and design elements — is the proprietary property of Attic Evolution or is used with permission, and is protected under applicable copyright, trademark, and intellectual property laws.
You may not reproduce, copy, redistribute, modify, or create derivative works from any portion of our website content without our express prior written permission. Unauthorized use may result in legal action.

User Responsibilities
When using our website or communicating with our team, you agree to:
- Provide accurate, truthful, and complete information in all forms and communications
- Use our website and services only for lawful purposes and in compliance with all applicable federal, state, and local laws
- Refrain from uploading or transmitting any malicious code, viruses, or harmful content
- Not attempt to gain unauthorized access to any portion of our website or systems
- Not impersonate Attic Evolution or any of our team members

Energy savings estimates referenced on our website (such as "up to 40% reduction in energy costs") are based on industry data and typical results. Actual results will vary depending on your home's size, existing insulation levels, HVAC system, usage habits, and other factors. These figures are illustrative and not guaranteed.
We do not warrant that our website will be uninterrupted, error-free, or free from security vulnerabilities.
Section 09
Limitation of Liability
To the fullest extent permitted by applicable law, Attic Evolution and its owners, employees, contractors, and agents shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising out of or related to your use of our website or services — even if we have been advised of the possibility of such damages.
Our total liability for any claim arising under this Agreement shall not exceed the total amount you paid to Attic Evolution for the specific services giving rise to the claim in the three (3) months preceding the event.
Nothing in these Terms limits our liability for death, personal injury, or fraud caused by our negligence.

Indemnification
You agree to defend, indemnify, and hold harmless Attic Evolution, its affiliates, owners, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your breach of these Terms
- Your misuse of our website or services
- Any false, misleading, or inaccurate information you provide to us
- Your violation of any applicable law or the rights of any third party
Section 11
Governing Law & Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.
Any dispute, claim, or controversy arising out of or relating to these Terms or our services shall first be addressed through good-faith direct communication between the parties. If a resolution cannot be reached within 30 days, the dispute shall be submitted to binding arbitration in the Dallas-Fort Worth Metroplex, Texas, in accordance with applicable arbitration rules. If arbitration is not enforceable, any legal proceedings shall be brought in the appropriate state or federal court located in Tarrant County, Texas, and you consent to the personal jurisdiction of such courts.
